This Policy sets out the rules for storing and accessing information via Cookies and the Administrator’s use of Google Analytics tools.

I. Definitions The phrases used in this Privacy Policy mean, respectively:

(2) Cookies (so-called “cookies”) – computer data, in particular text files, recorded and stored on the Users’ terminal equipment, intended for use by the User on the Website. The files referred to in the preceding sentence allow recognition of the User’s device and display the website accordingly. Cookies usually contain the name of the website they come from, the time they are stored on the User’s end device and a unique number. Cookies allow us to identify the software used by the User and customize the Website individually for the User.

3. Service – means the website under which the Administrator operates an Internet portal with the domain www.redmustang.pl The operator of the Service is the Administrator;

4. terminal device – means an electronic device through which the User accesses the Service;

5. User – means a person using the Service;

6. the DPA – the Act of August 29, 1997 (Journal of Laws No. 133, item 883) on the protection of personal data (and the legal act repealing the same, i.e. the Act of 10.05.2018 on the protection of personal data).

7. RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

II. Cookies

1 The Website uses Cookies. The entity placing Cookies on the End Device and accessing them is the Administrator.

(2) The Administrator uses two basic types of Cookies: a) Session Cookies: temporary files, stored on the End Device until the end of the session of a particular browser, after which the stored information is permanently deleted from the memory of the End Device. The mechanism of Session Cookies does not allow the collection of any personal data or any confidential information from the End Device; b) Permanent Cookies: files stored on the End Device until they are deleted. Ending the session of a particular browser or switching off the End Device does not delete them from the End Device. The mechanism of Persistent Cookies does not allow the collection of any personal data or any confidential information from the End Device. However, Persistent Cookies containing a unique identifier belong to the category of personal data and are therefore subject to the applicable data protection legislation.

(3) In connection with the processing of personal data (persistent Cookies containing a unique identifier) obtained from their disposer (data subject), the Administrator hereby informs:

(e) Personal data, at the time and to the extent necessary in connection with the purpose of data processing, may be transferred to an entity providing Internet services to the Administrator – server;

(f) Personal data is not transferred to a third country (however, the Administrator notes the use of Google Analytics, as discussed in Section III of this Policy);

(g) Legal basis for the processing of personal data: the data subject has consented to the processing of his/her personal data for one or more specified purposes (Article 6(1)(a) of the RODO);

h) The data subject has the right to request from the Administrator access to personal data concerning him/herself, rectification, erasure or restriction of processing, and has the right to object to processing, as well as the right to data portability – under the terms of the applicable data protection laws, in particular the PDPA and the RODO;

(i) The data subject shall have the right to lodge a complaint with a supervisory authority, in accordance with the procedure and pursuant to the regulations on personal data protection, in particular the PDPA and the RODO;

j) Personal data will not be used for automated decision-making processes, including profiling.

(4) An Internet browser usually allows the storage of Cookies on an End-User Device by default. However, the User has the ability to make changes in this regard and, consequently, to restrict, specify the conditions for storing or disable access to Cookies on his/her Device. Your Internet browser allows you to delete Cookies or automatically block them. 5 Restricting the use of Cookies may affect certain functionalities of the Website.

(6) The Administrator uses or may use Cookies for the following purposes: a) to create statistics that help to understand how Users use the Website, and which allows to improve the structure and content of the Website and its configuration – including: adapting the content of the Website’s pages to Users’ preferences and optimizing the use of the Website’s pages; recognizing the End Device and its location and displaying the Website accordingly;

(b) to remember the history of visited web pages on the Service for the purpose of recommending content;

c) correct configuration of selected functions of the Website, allowing, in particular, to verify the authenticity of the browser session;

(d) ensure the security and reliability of the Service.

III. External Cookies

(1) The Administrator also uses or may use the following external Cookies (i.e. Cookies placed by the Administrator’s partners, through the Website) to collect general and anonymous statistical data (reporting on Users’ interactions on the Website) through analytical tools: Google Analytics [in this regard, the administrator of the Cookies is Google Inc. with its registered office in the United States of America, 1600 Amphitheatre Parkway, Mountain View, CA, 94043].

2 Google Analytics, together with advertising functions, uses Cookies to analyze the use of the Website. The data received is processed in an aggregate and anonymized manner – and which makes it impossible to identify a person. The Administrator uses the so-called IP address masking, so that only parts of the addresses are used for the purposes indicated in point 1 above, and not their entirety.
